1. General

1.1 This policy regarding the processing of personal data (“Privacy Policy”) describes how WasteControl ApS (“WASTECONTROL”) collects and processes information about you.

1.2 The Privacy Policy applies to personal data that you provide to WASTECONTROL or that is

collected via WASTECONTROL’s website directly or through its links: www.wastecontrol.dk (“the

website”).

1.3 WASTECONTROL is the data controller for your personal data. All inquiries to WASTECONTROL

regarding this Privacy Policy can be made via the contact information listed in section 7.

1.4 WASTECONTROL protects your information with physical, electronic, and administrative

measures. You should always protect personal information when connected to the internet. At a

minimum, you should change your passwords often, use a combination of numbers and letters, and

ensure that your browser is secure. WASTECONTROL uses SSL (Secure Sockets Layer) encryption on

pages with personal information. Additionally, both sensor data and passwords are encrypted,

thereby protecting confidential information when transmitted via the internet.

1.5 WASTECONTROL’s website may contain references to other websites. WASTECONTROL generally

does not share your personal information with these and cannot be held responsible for their policy

regarding the protection of customer identity. WASTECONTROL encourages you to read the respective

websites’ policies regarding the protection of personal data.

1.6 WASTECONTROL only shares your information with named partners or persons/companies that

you have provided information about.

2. What personal data does WASTECONTROL collect, for what purposes, and the legal basis for processing

2.1 Visiting the website

2.1.1 When you visit WASTECONTROL’s website, it is done anonymously. WASTECONTROL does not

collect personal information, including your email address. However, the browser on your computer

provides the IP address, including your network location and the type of computer and operating

system you use.

2.1.2 The purpose is to optimize the user experience and the functionality of the website. This

processing of information is necessary for WASTECONTROL to pursue its interests in improving the

website and its functionality.

2.1.3 WASTECONTROL does not share your data with third parties for, for example, re-marketing/re-

targeting.

2.1.4 The legal basis for the processing is the EU General Data Protection Regulation Article 6(1)(f).

2.2 Customer registration

2.2.1 When you are registered as a customer (create an operational or viewer account),

WASTECONTROL collects the information you provide, such as name, address, country, valid email

address(es), phone number, password, location data, container ID, end-user ID, measurement

degree, and collected data. Additionally, WASTECONTROL collects information about sensor setup.

2.2.2 The purpose is to give you access to use WASTECONTROL’s databases for data collection and

management, visualization, etc. Furthermore, WASTECONTROL can fulfill its agreements with you

and your suppliers and offer you better customer service, including assisting you with issues related

to sensors and managing your rights to returns and complaints.

2.2.3 The purpose of collecting the information is also to ensure the optimal functionality of both

sensors and databases.

2.2.4 The legal basis for the processing is the EU General Data Protection Regulation Article 6(1)(a),

(b), and (c).

2.3 Search agents

2.3.1 When you create a WASTECONTROL search agent, information about your sensor status is

collected and forwarded to an operational function or contact person chosen by you.

2.3.2 The purpose is to pursue WASTECONTROL’s interest in being able to provide a database

function that ensures you full automation of the sensors.

2.3.3 The legal basis for the processing is the EU General Data Protection Regulation Article 6(1)(a),

(b), (c), and (e).

2.4 Viewer

2.4.1 When you create a given “Viewer” in the database, WASTECONTROL collects information about

this person/company. It is your responsibility to ensure that you have the legal basis to provide this

information and that the person/company in question is informed about WASTECONTROL’s Privacy

Policy.

2.4.2 The purpose is to provide the services you have ordered and otherwise fulfill WASTECONTROL’s

or WASTECONTROL’s partners’ agreement with you. Information about your sensor purchases is processed by WASTECONTROL to comply with legal requirements, including accounting and

bookkeeping.

2.4.3 The legal basis for the processing is the EU General Data Protection Regulation Article 6(1)(a), (b), (c), and (e).

3. Recipients of personal data

3.1 As a general rule, your data is never shared with third parties unless you expressly request it, or the

third party is

a) A WASTECONTROL partner who has sold/rented/lent you sensors

b) An operational unit or organization that you have provided information about

c) Persons/companies that you have provided information about

3.2 WASTECONTROL discloses the necessary personal data to the necessary partners (e.g.,

transporters/collectors/operational units and partners) in connection with the purchase/rental of

sensors.

3.3 Information to relevant public authorities (e.g., municipal administrations) will only be provided

upon written request and in connection with permissions on your behalf. Finally, your customer data

and information may be disclosed to the relevant public authority (e.g., the National Police) for

investigation purposes.

3.4 The information may include company name, recipient name, address and phone number, email

address, customer number, fill levels, container data, historical sensor data.

3.5 Information may be disclosed to external partners who process the information on behalf of

WASTECONTROL. WASTECONTROL uses external partners for, among other things, operation of the

financial system, mail system, mail filter, phone system, shredding, as well as technical operation

and improvements of the website. These companies are data processors, and under

WASTECONTROL’s instructions, they process data for which WASTECONTROL is responsible. The

data processors may not use the information for any purpose other than fulfilling the agreement with

WASTECONTROL and are subject to confidentiality. WASTECONTROL has entered into written

confidentiality agreements/data processing agreements with all data processors who process

personal data on WASTECONTROL’s behalf.

4. Your rights

4.1 In order to create transparency about the processing of your information, WASTECONTROL, as

data controller, must inform you of your rights.

4.2 Right of access

4.2.1 You are entitled at any time to request WASTECONTROL for access to the information that is

registered about you, the purpose of the registration, the categories of personal data and recipients of

information that may be, and information about where the information was collected from.

4.2.2 You can access the personal information WASTECONTROL has registered about you on your

personal page on the website. Here you can view and change this information.

4.2.3 You can always contact WASTECONTROL, if you have other changes or questions about your

information.

4.2.4 You have the right to obtain a copy of the personal data WASTECONTROL processes about you.

If you wish to obtain a copy of your personal data, you must send a written request to

privacy@wastecontrol.dk. You will be asked to document that you are the person you claim to be.

4.2.5 According to the instructions of the Data Protection Agency, the cost of the above is 10 DKK

including VAT per page started.

4.3 Right to rectification

4.3.1 You have the right to have incorrect personal data about yourself corrected. If you become

aware of errors in the information that WASTECONTROL has registered about you, you can log into

your personal page on the website, where you can change this information.

4.3.2 You can always contact WASTECONTROL if you have other changes or questions about your

information.

4.4 Right to deletion

4.4.1 In certain cases, you have the right to have all or certain personal data deleted by

WASTECONTROL, for example, if you withdraw your consent and WASTECONTROL has no other legal

basis for continuing the processing. To the extent that continued processing of your data is necessary,

for example, for WASTECONTROL to comply with its legal obligations or for legal claims to be

established, asserted, or defended, WASTECONTROL is not required to delete your personal data.

4.4.2 If you wish to have all or certain personal data deleted by WASTECONTROL and this is not

possible for one of the above reasons, WASTECONTROL will instead store your information protected

and with strictly limited access.

4.5 Right to restrict processing to storage

4.5.1 In certain cases, you have the right to have the processing of your personal data restricted to

storage only, for example, if you believe that the information WASTECONTROL processes about you is

incorrect.

4.6 Right to data portability

4.6.1 You have the right to receive your personal data in a structured, commonly used, and machine-

readable format and to transfer this data to another data controller.

4.7 Right to object

4.7.1 You have the right at any time to object to WASTECONTROL’s processing of your personal data

regarding direct marketing, including the profiling performed to target WASTECONTROL’s direct

marketing.

4.7.2 You also have the right, at any time, to object to the processing of your personal data that

WASTECONTROL performs based on a legitimate interest. See sections 2.1 and 2.3, if you believe that

your interests, rights, and freedoms outweigh WASTECONTROL’s interests in continuing the

processing.

4.8 Right to withdraw consent

4.8.1 You have the right at any time to withdraw a consent you have given to WASTECONTROL for a given processing of personal data.

4.8.2 If you wish to withdraw your consent, you can do so via the aforementioned personal page or by sending an email to privacy@wastecontrol.dk.

4.9 Right to complain

4.9.1 You have the right at any time to submit a complaint to the Danish Data Protection Agency,

Borgergade 28, 5, 1300 Copenhagen K, regarding WASTECONTROL’s processing of your personal data. Complaints can be submitted, among other ways, by email to dt@datatilsynet.dk or phone +45 33 19 32 00.
